The We are Geekin’ Marketplace (hereinafter “The Platform”) provides a digital venue for the Mauritian geek community to shop and sell. You agree to use this site for lawful purposes only and in a way that does not infringe the rights of others or restrict their use of the platform.
To buy or sell on the Marketplace, you must create an account. You can register directly or authenticate using third-party services like Google or Facebook (“Social Logins”).
Account Security: You are responsible for maintaining the confidentiality of your login credentials. If you use a Social Login, your account security is tied to the security of your Google or Facebook account.
Third-Party Authorization: By registering via Google or Facebook, you authorize We are Geekin’ to access, collect, and use specific information provided by these platforms (such as your name, email address, and profile picture) to create and manage your account.
Third-Party Liability: We are Geekin’ is not responsible for the accuracy, availability, or security of Google or Facebook. Any issues regarding those platforms must be directed to their respective support teams.
We are Geekin’ operates a multi-vendor marketplace connecting local Creators (“Sellers”) with Buyers.
Role of We are Geekin’ (Commercial Agent): By listing products on this Platform, the Seller appoints We are Geekin’ as their non-exclusive Commercial Agent (Mandataire). We are Geekin’ facilitates the transaction, processes the payment, and markets the goods, but does not take title (ownership) of the goods at any point.
Contract of Sale: The contract for the sale of goods is formed strictly and directly between the Seller and the Buyer. We are Geekin’ is not a party to this contract.
Seller Responsibilities: Sellers are solely responsible for:
The accuracy, quality, and safety of their products.
Fulfillment and Logistics: Packaging and shipping the item to the Buyer.
Compliance with all Mauritian consumer protection laws (e.g., warranty on defective goods).
Indemnification: The Seller agrees to indemnify and hold We are Geekin’ harmless against any claims, damages, or liabilities arising from the Seller’s products, failure to deliver, or breach of these Terms.
To ensure the security of transactions for both Buyers and Sellers, the following financial rules apply:
Collection of Funds: The Buyer pays We are Geekin’ (via Peach Payments or other gateways). The Seller acknowledges that We are Geekin’ receives these funds on behalf of the Seller (Funds held in Trust/Client Monies) strictly for the purpose of settling the transaction.
Escrow & Payout Condition: To protect the Buyer, We are Geekin’ will hold the funds in a segregated account. The net proceeds (Sales Price minus Commission Fee) will be released to the Seller only upon Proof of Dispatch or confirmed delivery.
Sellers must upload a valid Tracking Number or Proof of Delivery to the Platform to trigger the payout eligibility.
Commission Fees: We are Geekin’ charges a commission on each sale (as detailed in the Vendor Dashboard). This commission is deducted at source before the payout is made.
Self-Billing Mandate (Facturation pour compte de tiers): The Seller authorizes We are Geekin’ to issue invoices to Buyers in the name of and on behalf of the Seller. The Seller remains liable for any VAT or taxes due on the gross sales amount. We are Geekin’ will provide a monthly statement of commission fees, which constitutes our revenue.
We are Geekin’ reserves the absolute right to suspend, disable, or permanently remove any store or product listing that violates these Terms, or is deemed harmful to the community, without prior notice.
Prohibition of Illegal Goods: The sale of items illegal under the laws of the Republic of Mauritius is strictly prohibited. Sellers must ensure their inventory complies with all local regulations.
Strictly Forbidden Items (Non-exhaustive): For the safety of our marketplace, the following items are strictly forbidden from being listed or sold:
Vaping Products: Electronic cigarettes, e-liquids, and related accessories.
Counterfeit Goods: Unauthorized “bootleg” merchandise, pirated software, or fake designer items.
Obscene Materials: Pornographic or offensive media that violates Mauritian public decency laws.
Weapons: Firearms, underwater fishing guns, “yoyo water balls,” and dangerous projectiles.
Controlled Substances: Illegal drugs, CBD products, and prescription-only medications.
Endangered Species: Products made from ivory, tortoise shells, or protected wildlife.
Your privacy is important to us.
Data Collection: We collect your email address and name during registration to manage your account and process your orders.
No-Spam Promise: We will use your email to send you important order updates, shipping notifications, and marketplace news. We promise not to spam you or sell your data to third parties.
Opt-Out: You can unsubscribe from our marketing emails at any time via the “Unsubscribe” link at the bottom of our mailings. Order-related transactional emails cannot be opted out of. The We are Geekin’ Marketplace is provided “as is.” We do not guarantee that the website will always be available or error-free. To the maximum extent permitted by Mauritian law, We are Geekin’ acts only as an intermediary and is not liable for:
Disputes arising from shipping delays, product defects, or third-party seller errors.
Any indirect or consequential loss arising from your use of the marketplace.
These terms are governed by and construed in accordance with the laws of The Republic of Mauritius. Any disputes will be subject to the exclusive jurisdiction of the Mauritian courts.
